These Terms of Service (“Terms”) govern your access to and use of the LithicApp website, APIs, dashboard, and related services (the “Services”) provided by LithicApp (“LithicApp,” “we,” “us”). By using the Services, you agree to these Terms. If you use the Services on behalf of an organization, you agree on its behalf.
1. The Services
LithicApp provides software for building, automating, and monitoring business workflows through APIs, webhooks, and integrations. LithicApp does not provide banking, payment processing, money transmission, card issuing, lending, investment, or other financial services, and does not hold funds on behalf of customers.
2. Accounts
You must provide accurate information, keep your credentials and API keys secure, and are responsible for activity under your account. Notify us promptly of any unauthorized use.
3. Acceptable use
You will not use the Services to break the law; infringe others’ rights; send malware or spam; attempt to gain unauthorized access to systems; interfere with the Services’ operation; or reverse engineer the Services except where permitted by law.
4. Customer data
You retain ownership of data you submit to the Services. You grant us a limited license to process it solely to provide and improve the Services. You are responsible for having the rights and consents needed to submit it. Our use of personal information is described in our Privacy Policy.
5. Fees
Paid plans, if any, are described in your order form or plan page. Fees are billed in advance and are non-refundable except as required by law or stated in your order.
6. Intellectual property
We own the Services and all related intellectual property. Except for the limited right to use the Services under these Terms, no rights are granted to you. Feedback you provide may be used without obligation.
7. Third-party services
The Services may connect to third-party applications you choose. Your use of those applications is governed by their own terms, and we are not responsible for them.
8. Termination
You may stop using the Services at any time. We may suspend or terminate access if you breach these Terms or if required by law. Sections that by their nature should survive will survive termination.
9. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LITHICAPP WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS OR DATA. OUR TOTAL LIABILITY WILL NOT EXCEED THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM.
11. Indemnification
You will defend and indemnify LithicApp against claims arising from your use of the Services in violation of these Terms or applicable law.
12. Governing law
These Terms are governed by the laws of the United States and of the jurisdiction in which LithicApp is organized, without regard to conflict-of-law rules.
13. Changes
We may update these Terms. Continued use after the effective date of updated Terms means you accept them.
